European Union Intellectual Property Office (EUIPO)
The European Union Intellectual Property Office (EUIPO) is an institution of the European Union responsible for the registration and protection of intellectual property rights across all 27 EU Member States.
The office is headquartered in Alicante, Spain.
EUIPO is primarily responsible for:
-
the registration of European Union Trade Marks (EUTM),
-
the registration of Registered Community Designs (RCD),
-
supporting the protection of intellectual property rights within the European Union.
Thanks to a single application procedure, it is possible to obtain protection simultaneously across all EU Member States.
What Is a Trademark?
A trademark is a sign that allows the goods or services of one business to be distinguished from those of other entities operating on the market. It may include, among others:
-
a company or product name,
-
a logo,
-
a slogan,
-
the shape of packaging,
-
a color,
-
or even a sound.
Registering a trademark with the European Union Intellectual Property Office (EUIPO) grants the owner the exclusive right to use it throughout the entire European Union.
What Is an Industrial Design?
An industrial design protects the external appearance of a product, including its shape, lines, contours, colors, texture, and ornamentation.
Registering an industrial design with the European Union Intellectual Property Office (EUIPO) provides protection for the product’s appearance throughout the entire European Union.
What Is Not Allowed When a Trademark or Design Is Protected?
If a trademark or industrial design is registered:
❌ it is not permitted to use an identical or similar sign without the owner’s consent,
❌ it is not permitted to copy a protected product design,
❌ it is not permitted to market products that infringe registered rights,
❌ it is not permitted to suggest any affiliation with the trademark owner without authorization.
Violation of intellectual property rights may result in, among others, the obligation to cease using the protected sign, withdrawal of products from the market, and financial claims or legal actions.
